Abstract
The International Fact-Finding Commission mentioned by Article 90 of
Additional Protocol I is the only new measure introduced by the Diplomatic
Conference of 1914-1911 intended to strengthen implementation of
international humanitarian law. (The word 'humanitarian' was added to the
title by the Commission itself, in order to better express the Commission's
limited jurisdiction.) The Commission was established and its rules of
procedure were adopted, but never since 1977 has any party to an armed
conflict or any other State ever asked the Commission to exercise its
activity in a concrete situation. The author (a member of the Commission)
examines the reasons of this apparent failure and suggests new ways of
understanding Article 90. He has no doubts about the Commission's
usefulness, and he calls upon States and the other members of the
international community – in particular the United Nations – to accept the
Commission as a tool for strengthening respect for international
humanitarian law.

Il est facile de tirer à boulets rouges contre l'Avis consultatif de la Cour internationale de Justice du 8 juillet 1996 sur la licéité de la menace ou de l'emploi d'armes nucléaires. Aucun effort poussé de réflexion n'est requis pour cela: il suffit de choisir parmi la foule de critiques — souvent très dures — que l'on peut lire dans les déclarations et opinions (individuelles ou dissidentes) que tous les quatorze juges présents ont tenu à formuler, qu'ils aient été d'accord sur l'ensemble du dispositif, ou bien qu'ils aient voté contre tel ou tel de ses paragraphes.

1. Es fácil impugnar la opinión consultiva emitida, el 8 de julio de 1996, por la Corte Internacional de Justicia sobre la licitud de la amenaza o del empleo de armas nucleares. No se necesita un gran esfuerzo de reflexión para ello: basta elegir entre las muchísimas críticas —por lo general muy duras— que pueden leerse en las declaraciones y los dictámenes (individuales o disidentes) que todos y cada uno de los catorce jueces presentes formularon, sea que estuvieran de acuerdo con la parte dispositiva en su totalidad sea que votasen en contra de uno u otro párrafo.Por lo demás, hay motivos suficientes como para sentirse algo desorientados cuando se examinan los dictámenes de los jueces con respecto al fondo de la cuestión planteada por la Asamblea General, así como cuando tratamos de relacionar dichos dictámenes con el título del documento que cada uno de ellos eligió (declaración, dictamen individual, dictamen disidente), así como con el voto emitido.

It is easy to heap scorn on the Advisory Opinion handed down by the International Court of Justice on 8 July 1996 on the legality of the threat or use of nuclear weapons. No great cerebral effort is required; one need only choose any of the numerous and often harsh criticisms to be found in the declarations and the separate or dissenting opinions that all fourteen judges present took care to formulate, whether they agreed with the whole of the decision or voted against any of its paragraphs.
